Ripstr is experimental, unaudited software. Outcomes are random. You can pay more for a pack than the NFT you receive is worth, and you can lose the entire amount you spend or deposit. Nothing here is investment advice. Do not risk funds you cannot afford to lose entirely.
01Agreement to these terms
These Terms of Service (the “Terms”) govern your access to and use of the website at ripstr.fun and any related interface we publish (together, the “Interface”) operated by the persons who maintain and publish the Interface (the “Operator”, “we”, “us”). By accessing the Interface, connecting a wallet, or signing a transaction it constructs, you agree to be bound by these Terms. If you do not agree, do not use the Interface.
The Interface is one way to interact with the Ripstr protocol — a set of programs deployed on the Solana blockchain (the “Protocol”). The Protocol is autonomous and permissionless. These Terms govern the Interface. They do not, and cannot, govern the Protocol, which anyone can interact with directly without us.
02Eligibility
You represent that you are at least 18 years old and have the legal capacity to enter into these Terms; that you are not located in, resident in, or a national of any jurisdiction subject to comprehensive sanctions, and are not listed on any sanctions list; and that your use of the Interface does not violate any law applicable to you.
Determining whether the Protocol is lawful where you live is your responsibility, not ours. Some jurisdictions treat random-outcome mechanics as gambling. We do not give you advice on this and we do not represent that the Protocol is lawful in your jurisdiction.
03Non-custodial — we never hold your assets
The Interface is a front end. It does not take custody of your SOL, your $RIP, or your NFTs at any point, it never holds your private keys, and it cannot move your assets. Every state change happens because you signed a transaction with your own wallet.
While assets are in the Protocol they are held by on-chain program accounts under rules the programs enforce. They are not held by us, and we cannot reverse, cancel, refund or claw back any transaction you sign. Blockchain transactions are final.
04How the Protocol works
You should understand the mechanics before you use them. The values below are the Protocol’s current defaults; they are configurable on-chain and may change.
Deposits. A depositor escrows an NFT together with a SOL backing amount (minimum 0.01 SOL). That backing funds an irrevocable standing bid for that NFT and determines its selection weight. Weight is inverseto backing: the more SOL backs a position, the less often it is selected. Backing is never pooled with other depositors’ backing.
Ripping a pack.A purchaser pays a fee derived from the pool’s expected value plus a surcharge (10% by default) and receives one randomly selected position. Randomness comes from a third-party oracle. You may set price bounds on your own request; if the price moves outside them, or if the pool cannot fill your request, the fee is returned to you as a withdrawable credit rather than being charged.
Settlement.After allocation you choose, within 24 hours, either to keep the NFT or to accept the depositor’s standing bid and receive 85% of its backing in SOL instead. If you do not choose, the depositor may resolve it after that window, and after 7 days anyone may finalise it — by default the NFT goes to the purchaser and the backing to the depositor.
Fees.Each acquisition fee is split: 1% to the protocol, 5% to the holder of the “crown” (the largest active position), and the remainder shared equally across active positions. Pools created by third parties direct 40% of protocol fees to their creator.
Randomness. Selection is probabilistic. Odds shown in the Interface are estimates computed from on-chain state at the moment they are rendered, and they change as the pool changes. A displayed probability is not a promise about your outcome.
05No advice; no offer of securities
Nothing on the Interface is financial, investment, legal, tax or accounting advice, and nothing is a recommendation to acquire, hold or dispose of any asset. We do not offer or sell securities. $RIP is a utility token with no claim on any revenue, no equity, no entitlement to profit, and no promise of value. Statistics, odds, price estimates, floor-price data and profit-and-loss figures shown in the Interface are informational, partly derived from third-party sources, and may be inaccurate or stale.
06Fees
The Protocol charges the fees described in section 4. You also pay Solana network fees, account rent and any oracle fee for randomness. Oracle and network fees are consumed when the work is performed and are not refundable, including where your request is later refunded or expires.
The Interface displays a quote before you sign and submits that quote as a binding upper bound on the transaction. If the on-chain price has moved beyond it, the transaction fails rather than charging you more.
07Assumption of risk
You accept, at minimum, the risks that: smart contracts may contain bugs or be exploited, and the Protocol is unaudited; the randomness oracle may fail, be delayed or be manipulated; a position’s backing may exceed the market value of the NFT backing it, or fall far below it; NFT and $RIP prices are volatile and may go to zero; Solana may fork, congest, halt or reorganise; RPC providers, indexers and marketplace data may be wrong or unavailable; and you may lose access to your wallet, in which case nobody — including us — can restore it.
You are ripping packs with a random outcome. Over time, the surcharge means purchasers as a group pay more than the expected value they receive. Treat spending here as spending, not as investing.
08Your responsibilities
You are solely responsible for the security of your wallet and keys, for verifying every transaction before you sign it, for any tax arising from your activity, and for complying with the law where you are. You agree not to use the Interface to launder money, finance terrorism, evade sanctions, manipulate the Protocol’s markets or prices, infringe anyone’s rights, or attack, overload or reverse-engineer the Interface or the infrastructure serving it.
09Intellectual property
The Interface’s name, branding and design are ours. NFTs handled by the Protocol are the intellectual property of their respective creators; depositing an NFT grants us no rights in it and grants you no rights beyond those conveyed by the NFT itself. Images and metadata shown in the Interface are served from, or cached from, sources published by those creators.
10Third-party services
The Interface relies on third parties — wallet providers, RPC endpoints, the randomness oracle, indexing and marketplace data providers, and hosting. We do not control them, do not guarantee their availability or accuracy, and are not responsible for their acts or omissions. Links to third-party sites, including NFT marketplaces, are provided for convenience and are not endorsements.
11No warranty
The Interface is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Interface will be uninterrupted, timely, secure or error-free, that displayed data is accurate, or that defects will be corrected. We may modify, suspend or discontinue the Interface at any time without notice; the Protocol will continue to exist on-chain regardless.
12Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, digital assets or opportunity, arising out of or relating to your use of the Interface or the Protocol, whether based in contract, tort, strict liability or otherwise, and even if we were advised of the possibility.
Our aggregate liability for all claims relating to the Interface will not exceed the greater of (a) the total protocol fees we actually received from your transactions in the three months before the event giving rise to the claim, and (b) USD 100.
Some jurisdictions do not allow certain exclusions of warranty or limitations of liability. Where that is the case, those exclusions apply to you only to the extent permitted, and nothing in these Terms excludes liability for fraud or for anything else that cannot lawfully be excluded.
13Indemnity
You agree to indemnify and hold harmless the Operator and its officers, employees and contractors from any claim, loss, liability or expense (including reasonable legal fees) arising from your use of the Interface, your breach of these Terms, or your violation of any law or third-party right.
14Changes to these terms
We may update these Terms. The “last updated” date above changes when we do, and the updated Terms take effect when published. Continuing to use the Interface after that constitutes acceptance. Changes are not retroactive: transactions already settled on chain are governed by the Terms in force when you signed them.
15Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you use the Interface as a consumer resident in the European Union, this choice of law does not deprive you of protections granted by mandatory provisions of the law of your country of habitual residence.
Before bringing a claim, contact us at the address in section 16 and give us 30 days to resolve the dispute informally. Disputes that are not resolved informally are subject to the courts of the Operator’s seat in Germany; if you are a consumer, any venue mandatorily prescribed by law applies instead. We do not participate in consumer-arbitration proceedings and are not obliged to do so.
If any provision of these Terms is held unenforceable, it is severed and the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the Interface.
